What to Know About Commerical DUIs in New Jersey

A CDL, or a commercial driver’s license, is required to operate large, heavy, or hazardous material vehicles in commerce, including trucks, buses, and trailers. If you possess this kind of license, you most likely operate one of these vehicles for work. Driving under the influence with this type of license is considered a more serious offense than with a regular license. If you are facing charges for driving under the influence with a commercial license, contact our Middlesex County DWI Attorney so we can help to defend your livelihood.

What makes a commercial DUI in New Jersey?

A driver with a CDL can be charged with a DUI if their BAC is .04% or more. Commercial drivers are held to a higher standard than regular drivers who are charged with a DUI if their BAC is .08% or more.

What are the penalties?

A first-offense commercial DUI warrants a license suspension. You may also be prohibited from operating a commercial vehicle for three years if you received a DUI while transporting hazardous materials.

A second offense will permanently bar you from operating a commercial vehicle, which will result in the loss of your job and the need to switch career paths.

CDL drivers can also lose their commercial driving privileges for driving a passenger vehicle with a BAC of .08% or greater. They can face a suspension of their regular license for three to 12 months. They may also face a commercial license suspension for one year. If a commercial driver’s license holder receives a second DUI while operating a passenger vehicle, they can lose their regular license for two years and their CDL license permanently.
